Terms and Conditions: Boston & Century
1. Introduction
By accessing and using the Boston & Century website (the "Site"), you agree to be bound by these Terms and Conditions. These terms apply to all visitors, users, and customers of the Site.
2. Nature of Goods (Vintage & Antique)
Unique Condition: Most items sold by Boston & Century are vintage, antique, or secondhand. By purchasing, you acknowledge that these items will naturally show signs of age, wear, and tear.
Descriptions: We strive to describe and photograph all items accurately, including any significant damage or restoration. However, small imperfections are inherent to vintage items and are not considered "defects."
Viewing: We encourage customers to request additional photos or videos before purchasing if they have specific concerns regarding an item's patina or condition.
3. Pricing and Payment
All prices are listed in New Zealand Dollars (NZD) and include GST (unless otherwise stated).
We reserve the right to change prices at any time without notice.
Payment must be made in full via our Shopify checkout before any items are dispatched or collected.
4. Shipping and Delivery
Furniture Delivery: Due to the size and fragile nature of antiques, furniture shipping is quoted separately or handled via specialized furniture movers.
Risk: Once an item is handed over to a third-party courier or freight provider, the risk of loss or damage passes to the customer. We highly recommend purchasing transit insurance for high-value items.
Local Pickup: If "Local Pickup" is selected, items must be collected within 14 days of purchase unless otherwise agreed in writing.
5. Returns and Refunds (NZ Consumer Law)
Change of Mind: We are not legally required to provide a refund for "change of mind." Please measure your space carefully before purchasing.
Consumer Guarantees Act: We comply with our obligations under the NZ Consumer Guarantees Act. If an item is "not fit for purpose" or has a fault that was not disclosed or inherent to its vintage nature, we will meet our obligations to repair, replace, or refund.
Reporting Damage: Any damage sustained during transit must be reported to us within 24 hours of delivery, accompanied by photos of the packaging and the item.
6. Limitation of Liability
To the extent permitted by New Zealand law, Boston & Century shall not be liable for any indirect, incidental, or consequential damages resulting from the use of our products, including but not limited to the failure of vintage electrical components or structural integrity of antique furniture.
7. Privacy
Your personal information is handled in accordance with the New Zealand Privacy Act 2020. We only use your data to process orders and improve your shopping experience.
The "As-Is" Reality: Because you sell antiques, you must be careful. You cannot "contract out" of the CGA for consumer sales, but you can clearly state that "wear and tear consistent with age" is part of the characteristics of Object
Electrical Safety: If you sell vintage lamps or electronics, add a clause stating: "All vintage electrical items are sold as decorative pieces and should be checked by a certified electrician before use."
Storage Fees: Since furniture takes up a lot of space, it’s common to add a clause stating you will charge a weekly storage fee if an item isn't picked up within 7 Days.
